On August 18, nearly five months after beginning his inspection, Irineo Quintero, agent of the public prosecutor’s office, in view of the judgment issued by the officially appointed expert, Inspector Engineer José Aurelio García, requested that the case be dismissed, since as per the report it was impossible to determine the cause of the fire and there was, therefore, no crime to prosecute nor any person who might be held criminally responsible. The report contains not the slightest suggestion that someone could be held accountable for the deaths caused by the sealing of the shafts while miners were still alive inside, but it does explicitly back the theory that the fire may have been caused by a worker.

Six days later, the judge granted the dismissal and ordered the case to be closed.
